Influence the patent policy: EU Commission communication on patent policy is available for you

ProTon Europe is in the process of establishing Special Interest Groups. One of the Special Interest Groups deals with the Patent policy. As you know, the European Commission has been a long time in the process of making new proposals on the matter. Attached you find a link to the newly issued Communication for the new Patent Policy: Communication from the Commission to the European Parliament and the Council: Enhancing the patent system in Europe.

 

According to some representatives of the Commission, it could be possible that the Commission is making formal proposals under the Portuguese Presidency in the second half of 2007, if the Ministers of the Member States would endorse the approach in June.

 

A separate and comprehensive Communication on Intellectual Property Rights (IPR) is planned for 2008, to complement the Patent Communication and address outstanding non-legislative and horizontal issues in all fields of intellectual property.

There is also the possibility that some Member States would use Article 43 of the EU Treaty, if the Patent issue does not move in the legislative process. This method would in principle allow a smaller group of Member States to advance faster than the others. Even if this approach is not used, the possible availability to use this approach may put pressure for all the Member States to find a common approach.
